1. Eligibility and Parental Consent
By accessing the Website or participating in Services, you affirm that:

For minor participants:
• A parent or legal guardian must complete and sign all required intake forms, waivers, consent agreements, and policies prior to participation
• Coaching services for minors require ongoing parental consent
• Parents may withdraw consent at any time

We reserve the right to modify or update these Terms at any time. Changes become effective immediately upon posting on the Website.
Continued use of the Website or Services after updates constitutes acceptance of the revised Terms.
3. Permitted Use of the Website and Services

• performance preparation
Aspire Mindset does not provide:
• Therapy or counseling
• Psychological or psychiatric treatment
• Mental health diagnosis
• Medical advice
• Clinical mental health services
Use of the Website or Services does not establish a therapist-client, psychologist-client, counselor-client, or doctor-patient relationship.
5. No Medical or Mental Health Advice / Emergency Disclaimer
All information provided through the Website and Services is for educational and coaching purposes only.
Aspire Mindset is not a crisis response provider.
If you or your child are experiencing:
• a mental health crisis
• thoughts of self-harm
• thoughts of harming others
• a medical emergency

6. Confidentiality and Communication
Aspire Mindset respects the privacy of coaching participants.
However, users acknowledge that electronic communications are not completely secure.
Communication may occur through:
• SMS
• Zoom
• scheduling platforms
• coaching portals
• other digital tools
Confidential information may be disclosed when:
• required by law
• there is a reasonable concern of harm to the client or others
• abuse or neglect is suspected
• a parent/guardian authorizes disclosure
7. Coaching Platforms and Digital Tools
Aspire Mindset may use secure third-party platforms for:
• scheduling
• messaging
• session hosting
• coaching notes
• client management
By using our Services, you consent to the use of these platforms.
Parents or guardians of minor athletes must consent to the creation of any client account or profile used for coaching services.
8. Session Policies, Cancellations, and No-Shows
Unless otherwise stated in a coaching agreement:
• Sessions canceled within 24 hours may be forfeited
• No-show appointments may incur a $25 fee
• Coaching packages expire 12 months from purchase unless otherwise specified
• Missed sessions do not roll over
Specific policies for programs or packages may be outlined in separate service agreements.
9. Intellectual Property
All content on the Website and within coaching Services, including:
• training materials
• mental performance frameworks
• worksheets
• videos
• written materials
• downloads
• graphics
• logos
• website design
are the intellectual property of 4C Performance LLC DBA Aspire Mindset and are protected by intellectual property laws. These materials may not be copied, reproduced, distributed, or sold without written permission.
10. User Submissions
If you submit content to Aspire Mindset (including testimonials, comments, or feedback), you grant the Company a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for business or promotional purposes. We will never publicly share identifying information about minor athletes without parental consent.
11. SMS Communication Terms
Opt-In
By providing your mobile number, you consent to receive SMS communications regarding scheduling, service updates, and promotional messages.
Message and data rates may apply.
Opt-Out
You may unsubscribe at any time by replying STOP.
Administrative or service-related communications may still be sent.
12. International Users and Cross-Border Services
Aspire Mindset operates from the United States but may provide Services to clients internationally.
By using the Website or Services from outside the United States, you agree that:
• you do so at your own risk
• you are responsible for compliance with local laws
• your information may be transferred to and processed in the United States
13. Disclaimer of Warranties

Participation in coaching does not guarantee specific results.

• participation in coaching Services
• reliance on coaching information

Total liability, if any, shall not exceed the amount paid for the applicable coaching service.

You agree to indemnify and hold harmless 4C Performance LLC, Aspire Mindset, and its representatives from any claims, damages, liabilities, or expenses arising from:
